Terms & Conditions

These Terms and Conditions of Sale are established between: On the one hand, the Company NOWELD SPORT 2009 S.L., with Tax Identification Code B85716066 (hereinafter, NOWELD). On the other hand, any person who places an order via our online sales platform (hereinafter, the CUSTOMER).

These Terms and Conditions have been set out in accordance with the provisions of the Information Society Services and e-commerce Act 34/2002, the General Conditions of Contract Act 7/1998, the Royal Decree 1906/1999 which regulates the telephone or electronic contract with general conditions in progress in section 5.3 of Act 7/1998, the General Consumer Protection Act 26/1984, the Retail Trade Act 7/1996, the Royal Legislative Decree 14/1999 which regulates Electronic Signatures and all those legal dispositions as may be applicable.

1. Obligations

ORDERS.- The placement of an order by the CUSTOMER entails his or her full acceptance of prices, description of products for sale and the General Conditions of Sale, as well as any other condition specified in the order. To place an order, the CUSTOMER will have to give the personal details that are requested, unless he or she already has a customer number. NOWELD will inform the CUSTOMER as soon as possible if the required product is not available.

PRICES.- The prices shown on the website include the relevant tax at the time. NOWELD reserves the right to modify the prices without prior notice, excluding those products in an order that has already been placed.

INTELLECTUAL PROPERTY.- All the elements on the website www.virklon.com, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents rights.

ENTIRE AGREEMENT.- The present conditions of Sale represent the entire Agreement between both parties. If any provision of these Conditions shall be held to be null and void, it shall not affect any other provision.

APPLICABLE LAW AND JURISDICTION.- These conditions shall be governed by the laws of Spain. In case of any doubt, discrepancy or divergence which might arise from the observance and interpretation of the present Contract, both parties will submit themselves to the Courts of the consumer’s country.

2. Rights

DELIVERY.- The domestic CUSTOMER can choose between the following shipping options:

-Home delivery: The carrier will attempt to deliver the item twice at the specified address. If the item is not delivered, the recipient will then be able to collect it at his or her local Post Office. The shipping costs will be specified on the website.

-Local Post Office delivery: The item will be sent to the recipient’s local Post Office. The postal service will notify the recipient with a slip left in his/her letterbox. The postal service will also send a reminder if the item is not collected. Communication can also be reinforced with an SMS, as long as the customer has entered a mobile number. The shipping costs will be specified on the website.

-Delivery at specific Post Office: The item will be sent to the Post Office specified by the customer. The postal service will notify the recipient by SMS as soon as the item has been received. A reminder SMS can be sent after 5 and 10 days of the receipt. The client has more than 2,200 post offices all over the country, where the item will stay up to 15 days. The shipping costs will be specified on the website.

-To track an existing order, the CUSTOMER can check the “Order Tracking” section at www.virklon.com

PAYMENT.- The CUSTOMER can choose between the following payment options:

- Credit card

- Pay-Pal.

RIGHT OF WITHDRAWAL.- In accordance with section 45 of the Retail Trade Act 7/1996, of 15th January, modified by Act 47/2002, of 19th December, the right of withdrawal, protected by article 44 of the same Act, is repealed. The cause of that repeal is that all orders placed on our website are custom-made, and have been directly and specifically customised by the consumer.

FAULTY PRODUCTS.- In case of a faulty product, a worse quality than offered regarding fabrics or trimmings, or mistakes in costumization, the CUSTOMER must inform about this within 7 days of receiving the order to the following e-mail address: returns@virklon.com. We will then verify those facts and arrange for a return. Once the facts have been verified, NOWELD will then proceed to the exchange of the faulty items and will incur all the costs arising from this.

TREATMENT OF PERSONAL DATA.- NOWELD (NOWELD SPORT 2009, S.L., with registered office in ____________) guarantees that the processing of personal data will be subject to security levels that will prevent loss, mishandling or unauthorised access. In accordance with the Personal Data Protection Act 15/1999, of the 13th December, we inform that all data supplied by the CUSTOMER by any means, whether by placing an order, ordering a catalogue or subscribing to the NOWELD newsletter, and all along the commercial relationship with our company, will be stored into a file owned by NOWELD and will be treated with the utmost confidentiality.
